The Tanganyika Law Society (TLS) is the Bar association of Tanzania Mainland, founded in 1954 by an Act of Parliament – the Tanganyika Law Society Ordinance 1954. The Tanganyika Law Society is currently governed by the Tanganyika Law Society Act, Cap 307 R.E. 2002.

The Tanganyika Law Society (TLS) is inviting consultants from Tanzanian based individual consultants, company or consulting organizations to express their interest to participate in various consulting services as listed below.


The objective of this request is to inform interested reliable consultants’ that TLS intends to update its list of consultant in various consulting services, hence invites eligible and interested individual consultant, companies or consulting organization’s to express their interest for the provision of listed consulting services for the period 2020 – 2024.


The individual consultant, company or organization interested is requested to submit copies of relevant documents including Company Profile, Certificate of Incorporation, Current and Valid Business License, TIN, and VRN, for the individual consultants will be required to submit their CV detailing academic qualification and experience.

This is to inform you that the Governing Council has appointed Mr. Charles Rwechungura to be the Chairperson of the TLS Nomination Committee as per Tanganyika Law Society ( Elections) Regulations GN 116 of 2018.

The appointment has been made after receiving a resignation letter from the earlier appointed Chairperson of the Nomination Committee, Mr. Tom Nyanduga.

Tumekusanyika hapa kuadhimisha kilele cha maadhimisho ya Wiki ya Sheria ambayo ilianza tarehe 1 Februari 2020 na kuadhimishwa nchini kote. Ni adhimisho muhimu ambalo linatukumbusha juu ya msingi mkubwa wa utawala wa nchi yetu. Tunakumbushwa na kusisitiza kuwa nchi yetu ni ya jamhuri na ni ya kidemokrasia ambayo inaongozwa katiba na sheria zilizotungwa na Bunge. Kwamba watu wote katika nchi yetu wako chini ya sheria na wana mamlaka yao kwa mujibu wa sheria na wanatakiwa kuheshimu katiba na sheria za nchi yetu. Hakuna hata mmoja wao ambaye amepewa kinga ya kutofuata katiba na sheria na pale anapoikiuka basi anatakiwa kuwajibishwa. Aidha, ni siku ambayo tunakumbushwa majukumu muhimu sana ya muhimili wa mahakama. Huu ndiyo muhimili wenye jukumu azizi la kutoa haki katika nchi yetu na kutoa tafsiri sahihi ya katiba na sheria za nchi yetu. Kwa lugha ya kisheria ndiyo mlinzi asiyeyumba wa katiba na utawala wa sheria. Kwamba pale mahakama inapotoa maamuzi yake wahusika wote katika mgogoro huo n ahata wale walioko nje yake wanatakiwa kuheshimu na kutekeleza maamuzi hayo hata kama hawayapendi pasipo kuathiri haki yao ya kukata rufani au kuomba marejeo na mapitio. Uheshimuji wa katiba na sheria za nchi na maamuzi ya mahakama kunawapa hakikisho watu wote kuwa kikubwa na cha kufuatwa si mabavu au umbo la mtu bali ni sheria kwani watu wamekubali kuongozwa na sheria na si nguvu. Tunapozungumzia utawala wa sheria hatumaanishi utiifu wa sheria kandamizi. Watu wanatakiwa kukosoa utungwaji wa sheria ambazo zinapoka haki zao za kimsingi ambazo zinalindwa na katiba ya nchi yetu na hata kupinga ukatiba wa sheria hizo mahakamani.

Ndugu Mgeni Rasmi,

Mbiu ya maadhimisho ya Siku ya Sheria nchini ni ‘Uwekezaji na Biashara: Wajibu wa Mahakama na Wadau Kuweka Mazingira Wezeshi ya Uwekezaji.’ Ni mbiu ambayo inataka tutafakari kwa kina maana yake. Nchi yetu ipo katika jitihada kubwa za kuvutia wawekezaji wa ndani na nje kuja kuwekeza. Tafiti nyingi duniani zinaonyesha kuwa kile ambacho huwapa Imani na imani kubwa wawekezaji si kiwango kidogo cha kodi au misamaha ya kodi bali utawala wa sheria na kuheshimika kwa mfumo mzima wa haki. Sababu nyingine ni miundomsingi, uthabiti wa kiwango cha kubadilisha fedha, kiwango cha kodi, ukubwa wa soko, eneo nchi ilipo na ubora wa wafanyakazi, na faida. Ni wazi kuwa utengamano wa nchi na utawala wa sheria ndicho kitu kikubwa kinachoweza kuwavutia wawekezaji kuwekeza katika nchi yetu na kukuza uchumi wetu. Na Imani hiyo inakua na kuongezeka pale maamuzi ya mahakama juu ya migogoro yote iwe ya kibiashara, kikodi, kijinai na madai yanapoheshimiwa.

Ibara ya 107(1)A ya Katiba ya Nchi yetu inasema:

Mamlaka ya utoaji haki katika Jamhuri ya Muungano itakuwa mikononi mwa Idara ya Mahakama na Idara ya Mahakama ya Zanzibar, na kwa hiyo hakuna chombo cha Serikali wala cha Bunge au Baraza la Wawakilishi la Zanzibar kitakachokuwa na kauli ya mwisho katika utoaji haki.

Katiba yetu ipo wazi juu ya mamlaka ya mahakama na hivyo basi pindi kunapokuwa na kesi au mashauri yote ikiwemo ya uwekezaji na biashara ni vema yapelekwe na kutatuliwa mahakamani. Licha ya kuwepo hakikisho hili mikataba mingi ambayo nchi yetu inasaini na mataifa mengine inapoka madaraka ya mahakama zetu na kuyapa mashirika ya usuluhishi au uamuzi wa migogoro ya uwekezaji madaraka hayo. Kitu hiki si kizuri kwani kinakiuka ibara ya 107(1)(A) ya Katiba ya nchi yetu na Kanuni ya Umiliki wa Milele wa Rasilimali (Azimio  Namba 1803 la Mwaka 1962 Baraza Kuu la Umoja wa Mataifa)na Azimio Namba 3281 la Mwaka 1974. Pale ambapo mahakama zetu zinaheshimiwa na kupewa fursa ya kuamua migogoro yote ile kwa haki na bila shinikizo imani ya wafanyabiashara na wawekezaji kwake itaongezeka na hivyo kuondoa matakwa ya mataifa yaliyoendelea na makampuni yanayotoka kwao kuwa migogoro hiyo iamuliwe na mabaraza ya uamuzi ambayo kwa kweli wao ndio wanayamiliki.

Mahakama zetu zitaweza kuheshimika kuwa ni waamuzi wa haki wa migogoro kama zitakuwa na rasilimali fedha na watu wa kutosha pamoja na vifaa vya kuandika na kurekodi hoja za wadaawa. Hivi sasa mahakimu na majaji wanaandika hoja na ushahidi wa wadaawa kwa mikono na hii inarefusha muda wa kusikilizwa kwa kesi. Katika nchi za wenzetu hali si hivyo kwani majaji na mahakimu wao husikiliza na pengine kuandika hoja chache sana kwani yote yanayosemwa na wadaawa huandikwa na wachapaji wa mahakama (stenographers) au hurekodiwa na vifaa vya kurekodi. Kulikuwa na jitihada za kuweka vifaa vya kurekodi katika Mahakama Kuu Kitengo cha Biashara lakini huu haujawa utamaduni dumivu. Ni rai ya TLS kuwa jitihada za makusudi zifaanyike ili kesi zote ziwe zinarekodiwa na kuandikwa na kuhakikisha kuwa kile kilichosemwa na wadaawa na mawakili wao kinaandikwa kwa ukamilifu na hivyo kuwezesha kusikilizwa kwa kesi nyingi.

Ndugu  Mgeni Rasmi,

 Kwa kifupi napenda nichukue fursa hii kukumbushia historia ya Chama Cha Mawakili Tanganyika mpaka sasa. Mwezi wa Januari, 2020, Chama cha Wanasheria wa Tanganyika kimetimiza miaka 65 tokea kuanzishwa kwake. Kwa uhakika miaka 65 ni umri wa mtu mzima kustaafu utumishi isipokuwa tu kwa wale wenye majukumu maalumu na wale ambao huongezewa muda kupitia mikataba. Mapaka sasa orodha ya mawakili waliopo kwenye kitabu cha orodha ya mawakili (Roll of Advocates) imefikia 9372. Katika orodha hiyo waliotangulia mbele ya haki ni mawakili 234 na wanaofanya kazi ya uwakilishi mahakamani ni 8,667. Idadi hii ya 8,667 inabadilika badilika kwasababu kuna mawakili wa utumishi wa umma ambao sheria imewalazimu waache uwakilishi wa kujitegemea na hivyo wako kwenye hatua za kukamilisha mchakato. Wale walioahirisha kazi za uwakili wa kujitegemea wanafikia 412 na wale wanaofanya kazi ya kuapisha tu au kugonga mihuri (notorisation) ni 14. Katika idadi hii vijana wanakadiriwa kuwa ni asilimia 75% ya mawakili walio hai. Hivyo, tunajukumu kubwa la kuwajengea uwezo wa kimaadili na uzoefu wa kazi ya uwakilishi. Chama kimeweka na kinaendelea kuweka mifumo mbalimbali ya kuwajengea uwezo ikiwa ni pamoja na uadilifu, elimu endelevu ya kisheria, na uzoefu wa kazi ya kisheria. Kwa hali hii katika kuhakikisha kuwa kila mwanachama anapata huduma, chama kinatoa huduma yake ya ushauri kitaaluma, na kila mwanachama anapata nafasi ya kuihudumia jamii, chama kinaendelea kuanzisha matawi kwa katika mikoa ya Tanzania na haswa pale palipo na Mahakama kuu. Mpaka sasa tuna matawi 14 na tayari kuna maombi ya kuanzisha matawi mengine matatu katika mikoa ya Kigoma, Mara, Rukwa.


Hata hivyo napenda kusema kuwa mabadiliko ya sheria ya Chama chetu yatatuongezea mzigo mkubwa sana wa uendeshaji kwani kufanya mkutano mkuu kwa uwakilishi utasababisha chama chetu kitumie si chini ya shilingi milioni 300 kwa mwaka. Fedha hizo hatuna. Utaratibu wetu wa sasa ni kuwa kila mwanachama ana jukumu la kujigharimia ili ahudhurie Mkutano Mkuu na hakuna malalamiko yoyote kutoka kwa wanachama wetu juu ya hilo kwani wao wanaona kuwa Aidha, uanzishwaji wa Ofisi za Kanda ni mzigo mkubwa sana kwa chama chetu na una hatari ya kuleta tatizo la ukanda na hivyo kumomonyoa utaifa ambayo ni nguzo kubwa ya chama chetu.

Ningependa kwa upekee niongelee suala la mabadiliko ya sheria katika mfumo jinai na haswa haswa katika mambo makubwa mawaili au matatu yanayohusu mihimili yetu. Jambo la kwanza ni lile linalohusu mfumo wetu wa jinai kubaki na misingi au madhumuni ya kikoloni ambayo malengo yake makuu yalilikuwa kushikilia mtuhumiwa au mharifu kwa kipindi kirefu ndani ya mahabusu au magereza kwa lengo la kuweka hofu kwa wanannchi ili watii amri za kikoloni bila kuhoji.  Mara kadhaa tumekunukuu wewe na watangulizi wako mkihoji suala la kutokamilika kwa upelelezi ilihali mtu amekamatwa na ushahidi. Mfumo wa kikoloni ndivyo ulivyokuwa kwa sababu haukuwa na lengo la kumhukumu mtuhumiwa papo kwa papo. Ulikuwa na lengo la kutishia.  Hivyo hata sasa waendesha mashitaka hulazimika kutumia mfumo huo huo kwa sababu wamejifunza na kufanyia kazi mfumo huo.

Inabidi ikumbukwe kuwa muda wa mwanadamu hapa duniani una ukomo wake na hakuna mwenye uwezo wa kuongeza ila Mwenyezi Mungu. Kila siku ambayo mtu anapokwa uhuru wake kwa kuwekwa ndani siku hiyo haitarudi. Na nchi yetu haina mfumo wa kumfidia mtu ambaye alipokwa uhuru wake na baadae kesi yake kufutwa au kukutwa hana hatia.

Ibara ya 14 ya Katiba ya Nchi yetu inatoa haki ya kuishi na “kupata kutoka kwa jamii hifadhi ya maisha yake kwa mujibu wa sheria”. Aidha, Ibara ya 15 (1) inasema “Kila mtu anayo haki ya kuwa huru na kuishi kama mtu huru.” Ibara ya 15(2) inataka mtu asishikwe na kuwekwa ndani au kuhamishwa kwa nguvu na kupoteza uhuru wake isipokuwa mujibu wa sheria na pindi mtu anapokuwa ametiwa hatiani. Hili kukidhi matakwa haya inabidi polisi na waendesha mashitaka kujiridhisha kuwa pale wanatoa tu amri ya kushikwa na kuwekwa ndani pale upelelezi unakuwa umekamilia. Aidha, haki ya kupata dhamana iheshimike. Ni vema pia uamuzi wa Mahakama ya Rufani katika kesi ya Attorney General v. Jeremiah Mtobesya Civil Appeal No 65 of 2016 ambapo ilisema kuwa kipengele kinachompa madaraka Mwendesha Mashitaka Mkuu wa Serikali kuweka cheti cha kuzuia dhamana hata kwa makosa yanayodhaminika ni kinyume cha katiba ya nchi yetu. Tulitegemea kuwa kutokana na uamuzi huo sheria zote zinazotoa mamlaka hayo zingebadilishwa lakini sivyo ilivyo. Hadi hivi sasa watuhumiwa wengi wenye kukabiliwa na kesi za jinai wapo ndani licha ya kuwa makosa yao yanadhaminika lakini wamewekewa hati hiyo.

Ni rai yetu kuwa mabadiliko ya suala hili linahitaji utashi wa kisiasa ili kubadilisha suala hili na pengine kuondokana kabisa na hali hii na kuepusha gharama kubwa za uendeshaji wa mashauri na kushikilia watuhumiwa kwa kipindi kirefu. Ni vyema tujikite kutafakari kwa makini ili tuweze kuweka mfumo mzuri wa kushikilia mahabusu na wafungwa kwa muda mfupi zaidi ili nchi yetu isikae na watuhumiwa wengi mahabusu hata magerezani kwa muda mrefu.

Vivyo hivyo, ni vyema tukafanya mabadiliko ya kuwa na namna bora ya kuwatumia wafungwa ikiwa ni pamoja na kifungo cha nje kilichopo kisheria hivi sasa ili walete tija katika uzalishaji wa kitaifa na kuchangia uchumi wa nchi kwa muda mfupi badala ya kuendelea kulipatia taifa gharama kwa muda mrefu wakati tayari kwa kupatkana hatia wameshatuingiza gharama kubwa.  Kwa kufanya hivi nchi itafaidika na mambo mengi sana ikiwamo kupunguza msongamano kwenye magereza, kuonekana wazi tunaheshimu haki za binadamu na utawala wa sheria na wakati huo huo tukikuza uchumi wa taifa kupitia watuhumiwa na wafungwa.

Jambo la pili linaangukia katika muhimili wetu wa Bunge katika utungwaji wa sheria. Ni wazi kwamba falsafa ya utungwaji wa sheria inahitaji mabadiliko kwa kiasi kikubwa kwa watunga sheria, wananchi na wasimamizi wa sheria kiujumla. Wapeleka miswaada bungeni, wabunge na hata wananchi bado hawajafahamu vyema dhana ya adhabu wanazopendekeza na baadae kufanywa kuwa sheria. Kwa kiasi kikubwa dhana iliyojengeka ni kutoa adhabu kali badala ya kutoa mafunzo kwa mkosaji na wengine ili kuzuia zaidi.  Sheria ikijikita katika falsafa ya kutoa adhabu kubwa au kali huwa haitoi fundisho, haifadishi nchi, na pengine hutekelezeka kwa upande mmoja ambao ni kumshikilia mtuhumiwa lakini haitekelezeki upande wa pili ambao ni faini kwa sababu faini zinazowekwa hazilipiki na hivyo kujikuta tunajaza watu magerezani kwa wakosaji kushindwa kulipa faini!!

Inajulikana wazi kuwa faini na adhabu za kifedha ni chanzo kikubwa cha mapato ya nchi. Kama sikosei ni chanzo cha tatu au nne ukiondoa kodi, tozo za leseni na michango ya mashirika ya umma. Faini au adhabu zikiwekwa katika kiwango kinachowezekana kulipika kwa wakosaji kinachangia kwa kiasi kikubwa katika pato la nchi kwa sababu kinalipika kiurahisi na wakati huo huo kinabadilisha tabia ya wakosaji wa kujirudia rudia kiurahisi pia. Faini au adhabu kubwa hailipiki na hivyo kulazimika kuchukua mfumo wa kuwekwa ndani (incarceration) ambao huleta gharama ya kuwahifadhi na pengine rushwa kwa wakosaji kutoa hongo ili kuepuka kufungwa. Tuchukue mfano ya makosa kadha wa kadha ya barabarani.

Ndio shilingi elfu 30 za kitanzania ni ndogo na zinalipika kiurahisi kwa mkosaji lakini zimeweza kupunguza makosa ya barabarani kwa kiasi kikubwa na wakati huo huo yamechangia kwa kiasi kikubwa kwenye pato la taifa. Ukiendesha gari lako kwa faulo kutoka Dar es Salaam kuja Dodoma unaweza jikuta unamaliza pesa ya mafuta. Hivyo ukikamatwa mara mbili yaani elfu 30 mara mbili tayari unaanza kumaliza fedha yako ya matumizi na hivyo kuogopa kuendesha kwa kasi kwa kuogopa kukamatwa. Na pengine hata ukiona mtu kavaa kanzu nyeupe kwa mbali unapunguza mwendo kwa kudhani ni afisa usalama barabarani.

Kwa kuweka adhabu zinazotekeleka ni imani yetu mawakili kuwa hata watendaji wa kimahakama na watendaji wengine wa umma watapata urahisi kuyasimamia na kukusanya adhabu hizo ili zichangie katika pato nchi.

Jambo la tatu linahusu mamlaka ya mahakama za chini ambazo hazina mamlaka ya kusikiliza makossa makubwa ya jinai kama vile mauaji, uhujumu uchumi na mengine yote yaliyoainishwa na sheria mbalimbali yanayolazimisha kusikilizwa na mahakama kuu tu. Ni vyema suala hili likaangaliwa kwa makini hasa hasa mamlaka ya mahakama hizi kwani kwa kusema hazina mamlaka ya kusilikiza shauri hata kwa mambo madogo madogo na pengine makubwa kunachangia kwa kiasi kikubwa sana ucheleweshaji wa mashauri, kunyimwa kwa haki ya kusikilizwa kwa wakati, kutotabirika kwa muda wa uendeshaji wa shauri lake, kuongeza gharama kwa magereza ambao hulazimika kuwatunza mpaka pale shauri lao litakaposikilizwa. Mtu wa kawaida hujiuliza au watu wanyonge hujiuliza swali dogo tu kuwa, kama mahakama haina mamlaka sasa kwanini shauri lake linapelekwa kwa hakimu asiyekuwa na mamlaka?  Ni vema utaratibu wa kupeleka kesi katika mahakama isiyo na mamlaka ukomeshwe na kesi zipelekwe tu kwa mahakama zenye mamlaka.

Aidha zuio la mawakilili kufanya kazi katika Mahakama za Mwanzo liondolewe kwani hivi sasa Mahakama hizo zinaongozwa na Mahakimu Wakazi wenye shahada ya kwanza ya sheria. Na katazo hili linazuia wananchi wengi kupata huduma ya uwakilishi. Mahakama hizi za mwanzo ndizo ambazo zinasikiliza kesi nyingi nchini. Hivyo mawakili kufanya kazi katika mahakama hizo kutawawezesha wananchi kupata huduma za mawakili na kuwezesha haki kupatikana katika ngazi zote.

Kama nilivyotangulia kusema hapo awali, uwepo wa chama kila mahali na idadi kubwa ya vijana chama kina majumu makubwa ya kuwajengea uwezo wa kimaadili na uzoefu wa kazi ya uwakilishi. Chama kimeweka na kinaendelea kuweka mifumo mbalimbali ya kuwajengea uwezo ikiwa ni pamoja na uadilifu, elimu endelevu ya kisheria, uzoefu wa kazi ya kisheria, na kutoa huduma ya kisheria nchini ikiwa ni pamoja na ushauri wa kisheria au uwakilishi wa bure kwa wasiojiweza/wanyonge wakiwemo. Hali hii inaleta changamoto ya kifedha na miundombinu. Chama kinahitaji kuwa na majengo ili kiweze kutoa mafunzo maalumu na endelevu ya kisheria ili kuwe na ubobevu (specialization) wa kisheria kwenye mambo ya kisheria yanayoongezeka kila kukicha; na chama kinahitaji fedha za kujiendesha na kujenga majengo ya kufundishia na kutoa hudumu kwa faida ya watanzania ili waweze kutatua migogoro yao kitaaluma na kisha kuwahi kwenye uzalishaji. Hivyo basi, chama kinahitaji kuungwa mkono kwa kupewa ardhi ikiwezekana na fedha kiasi ya kujenga katika mikoa mbalimbali ya Tanzania ikiwamo hapa Dodoma ili kiweze kutoa huduma hii kiufasaha.

Nimalizie sasa kwa kusema machache kuhusu muhimili wa Mahakama ambao unatija za kimsingi nchini kwetu katika hali zote za kiuchumi, kisiasa, kiutamaduni na hata mila na desturi zetu. Ningependa kutoa rai kwa mahakama ambayo ina dhamana ya kulinda haki kwa watu na vyombo vyote vilivyomo kwenda mbele zaidi ili iweze kushiriki kikamilifu katika kufanya maboresho ya sheria kwa njia ya hukumu. Naiomba mahakama isiogope kufanya maamuzi magumu ya kutengua vipengele vya sheria ambavyo vinaonekana vinaleta ukakasi kwenye katika utekeleza wa haki. Tafsiri sahihi za kiutendaji zinafanywa na mahakama. Hivyo mahakama isaidie jamii kufanya hivyo. Najua mawakili wanaleta mashauri yanayoiomba mahakama kufanya mabadiliko ya sheria kwa kutengua baadhi ya vifungu. Kama maombi hayaambatani ni utafiti unaojitosheleza, ni vyema mahakama iwaamuru mawakili wakafanye utafiti wa kina ili iweze kutoa maamuzi yanayojitosheleza katika kufanya maboresho ya sheria kwa faida yetu sote.

Baada ya kusema hayo machache ninapenda kushukuru sana kwa mwaliko huu na kutoa wito wa kudumishwa kwa utawala wa sheria katika nchi yetu na uhuru wa mahakama.
